Minnesota has a six-year statute of limitations for filing a personal injury lawsuit. This means victims of car, truck, and other accidents caused by the negligence of another party have six years after the accident to file a legal claim.
Some exceptions may shorten or lengthen this deadline. For example, the “discovery of harm” rule allows the statute of limitations to begin when you discover the damage. In some circumstances, this may come after the date of the actual incident.
Minor children injured in an accident have one year after their 18th birthday to file a personal injury claim, regardless of how young they were when they were injured.
Wrongful Death Statute of Limitations
